REPORT CONTENT OR COPYRIGHT

People put content on the VERTX Platform: profiles, CVs, photographs, videos, portfolio links, job posts, messages and files. VERTX TALENT LTD (Company No. 16902446, registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ) stores that content for them. If you think something on the Platform infringes your copyright or another of your rights, or is unlawful, tell us and we will act on it quickly. This page explains how, and how to appeal or complain if we restrict or remove your content or your account, or if you are unhappy with how we deal with online safety.

1How to report

Email legal@vertxtalent.io with the subject line "Content report". You do not need an account to report, and you do not need to be a VERTX user.

Where a profile, video, job post or message on the Platform shows a Report control, you can use it instead. It sends the same report to the same team.

If the content puts someone's safety at risk, say so in the subject line and we will deal with it first. If someone is in immediate danger, contact the police.

2What to include

So that we can find the content and act on it, please include:

  • Where it is. The web address (URL) of the page, and the profile, job post or message it appears in, with enough description for us to find the exact item.
  • What is wrong with it. The right you say is infringed (for example copyright, a trade mark, confidential information or your privacy), or the law you say it breaks, and why.
  • For copyright and other intellectual property. The work you say has been copied, and whether you own the right or are authorised to act for the person who does.
  • Your details. Your name and email address, and if you are acting for someone else, who they are.
  • A statement of good faith. A statement that you believe in good faith that the information in your report is accurate and, for an intellectual property report, that the use you are reporting is not authorised by the rights owner or by law.

A report without these details can still be made, but it may take us longer, because we may need to ask you for them.

3What we do

3.1We acknowledge your report, normally within two working days, and on the same working day if you tell us someone's safety is at risk.

3.2When a report shows us that content on the Platform is unlawful, or makes that apparent, we remove the content or restrict access to it expeditiously. While we look into a report we may restrict the content, or the account that posted it, so that no further harm is done.

3.3We tell the person who posted the content that it has been removed or restricted and why, unless the law or a risk of harm to someone stops us. We share your name and email address with them only if you agree, or if the law requires it.

3.4We close the accounts of people who repeatedly post infringing or unlawful content, under section 12 of our Terms of Service.

3.5We keep a record of each report and what we did about it.

4If your content was removed

If content you posted was removed or restricted and you believe the report was mistaken, you can send us a counter-notice at legal@vertxtalent.io. Please include:

  • the content and where it was on the Platform;
  • why you are entitled to use it, or why it is not unlawful;
  • your name and email address; and
  • a statement that you believe in good faith that the content was removed or restricted by mistake.

We acknowledge a counter-notice within two working days, review it, and aim to tell you what we have decided within ten working days. If we are satisfied that the content is lawful, we restore it. We may pass the substance of your counter-notice to the person who reported it, so that they can take the matter up with you directly. Our decision on a report or a counter-notice does not affect anyone's right to take the matter to court.

5Appeals and complaints

5.1If we restrict or remove your content or your account. If we remove or restrict something you posted, or warn, restrict, suspend or close your account, for any reason (including a report from someone else or a breach of our terms), we tell you what we did and why, unless the law or a risk of harm to someone stops us. You can appeal by emailing legal@vertxtalent.io with the subject line "Appeal", within three months of being told. Say what was restricted or removed and why you think the decision was wrong. We will still look at a later appeal if there is a good reason it could not be made sooner.

5.2If an automated check stopped or changed your message. Messages and profile text are checked automatically for threats, abuse and attempts to move contact or payment off the Platform, as our Privacy Policy explains (section 6). A message that appears to contain threats or serious abuse is not sent, and contact details may be hidden. If you think an automated check got it wrong, appeal in the same way, with the subject line "Appeal: automated check". An automated check never restricts or closes an account on its own: a member of our team looks at it first.

5.3How we decide an appeal. A person reviews every appeal, and where possible it is someone who was not involved in the original decision. We acknowledge an appeal within two working days and aim to decide it within ten working days. If we were wrong, we restore the content or the account, and lift any restriction. We tell you the outcome and the reasons.

5.4Complaints about how we deal with online safety. If you think we are not meeting our duties under the Online Safety Act 2023, for example in how we handle reports, how we use automated checks, or what our terms say about them, email legal@vertxtalent.io with the subject line "Online safety complaint". We acknowledge it within two working days and reply within twenty working days, telling you what we found and anything we have changed.

5.5We keep a record of each appeal and complaint, and of what we did about it. Using this process does not affect your right to go to court, or to complain to the Information Commissioner's Office about how we use your personal data.

6Our role as a host

VERTX stores content at the request of the people who provide it. We do not check every item before it appears, and we are not a party to a dispute between the person who reports content and the person who posted it.

Under regulation 19 of the Electronic Commerce (EC Directive) Regulations 2002, a business that stores information provided by others is not liable for that information where it does not know of unlawful activity or information and, once it knows or becomes aware of facts that make it apparent, acts expeditiously to remove it or disable access to it. This process is how we meet that standard.

7Other requests

  • Your personal data. To use your data protection rights, write to privacy@vertxtalent.io, as set out in our Privacy Policy.
  • A security problem. To report a vulnerability, write to security@vertxtalent.io.
  • Someone breaking our rules. Conduct that breaks the Terms of Service or the Security and Acceptable Use Policy, rather than content that infringes a right or a law, can be reported in the same way, to legal@vertxtalent.io.
  • Anything else. For any other question or complaint about VERTX, write to hello@vertxtalent.io or use Support in your dashboard.
