VERTX UK TALENT TERMS
These terms are between VERTX TALENT LTD (Company No. 16902446, registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ) ("VERTX", "we", "us") and you, a person aged 18 or over living in the United Kingdom who creates a profile on the VERTX Platform for UK direct hire ("you").
VERTX acts as an employment agency for you. We help you find work with UK companies that employ or engage you directly. We are not your employer and we do not supply you to companies as a temporary worker.
1What VERTX does
1.1VERTX introduces you to UK companies that are hiring. Remi, our AI, helps you build your profile, and we match it with companies' roles.
1.2You decide which introductions to accept. Saying yes to a company commits you to nothing more than a conversation.
2We never charge you
2.1Finding you work is a service the law does not allow us to charge you for, and we never will. We do not offer you any paid services. VERTX never charges you anything, for joining, for introductions or when you are hired. Companies pay us, never you. How a company pays us, including what happens to its payments if you leave, is between us and the company: it never affects your pay and is never passed on to you, and we will never ask you to repay anything.
2.2VERTX does not pay you. Your pay is agreed between you and the company that hires you.
2.3You never have to tell us who hires you or where you go next, and nothing changes for you if you stop using VERTX.
3Your right to work in the UK
3.1To use UK direct hire you must have the right to work in the UK. UK law treats a matching service like ours as responsible for checking the right to work of the people whose details it shows to companies. So before your profile is shown to any company, we carry out a right to work check in a way the law prescribes. You can create your account and build your profile first; the check is in your dashboard, and until it is passed no company can see your profile in any form.
3.2We check everyone the same way, whatever their nationality. Depending on your documents, the check is:
- for a British or Irish passport or Irish passport card (current, or expired by up to six months), a digital check through Veriff, a provider certified by the UK government for right to work checks. You scan your passport and take a live selfie, which is matched to your passport photo;
- for an eVisa or other UK immigration status, a Home Office online check using a share code you give us, followed by a short video call in which a member of our team compares you with the photo on the Home Office record;
- otherwise, a check of your original documents with you on a video call, or a check with the Home Office Employer Checking Service.
If you would rather not have your face matched digitally, you can choose a video call instead. You agree to give us the information, and take part in the steps, needed to complete the check.
3.3If your permission to work in the UK has an end date, you must complete a follow-up check on or before that date. We will remind you beforehand. If a follow-up check is not passed by then, we stop showing your profile to companies until it is.
3.4You must tell us promptly if your immigration status or permission to work changes, or is curtailed, refused or ends.
3.5We may keep your profile hidden from companies, or close it, if we cannot complete a check, if a check shows you do not have the right to do the work, or if we reasonably believe information you have given us is false. A member of our team reviews any failed or unclear result before we decide, and we will tell you what happens next.
3.6Our check is for our own legal compliance as a matching service. It is not a check for the company that hires you: any company that employs or engages you must carry out its own right to work check before you start. That is normal and required by law.
3.7We keep the record of your check for as long as your profile is available to companies and for two years after that, as the right to work rules require, and then delete it securely. We do not keep your share code once the check is complete.
4What we check, and what companies see
4.1Before your profile is shown, we confirm your email address, that you have a UK mobile number (by an SMS code where that is switched on), and your right to work (clause 3). If something on a profile needs a closer look, we may ask you to verify your identity with our identity provider before you continue. It takes about two minutes.
4.2If we ask you to verify your identity, Veriff checks your identity document and a live selfie. We ask for your explicit consent first, and you can choose a video call with our team instead. We receive only the result, the name on the document and the document's issuing country and type. There is no separate identity badge.
4.3Companies see a "Right to work checked by VERTX" indicator with the date of our check. It means only that we completed the check in clause 3 on that date. Companies never see your documents, your nationality or your immigration category.
4.4VERTX does not assess UK candidates, and does not carry out background, criminal record or reference checks.
5Companies hire you directly
5.1A company that hires you employs you as its own employee, or contracts with you (or your own company) directly. VERTX is not your employer and is not a party to that employment or contract.
5.2The company is responsible for your contract, your pay, and the checks an employer must make. You agree to answer the questions on your profile truthfully.
5.3Before we ask whether you want to meet a company about a role, we tell you what the company has told us about it, including the company, the role and type of work, where and when it is done, when it starts and for how long, the pay (or minimum pay) and how often it is paid, other benefits, notice periods, and any experience or qualifications it needs. We only put you in touch with a company about a role after you have told us you want to.
6Matching and Remi
6.1Companies set criteria for each role. Remi, our AI, grades the evidence in your profile against each criterion, and our software uses fixed rules to decide which candidates are put forward to the company first. Matching never uses your health, ethnicity, religion or any other special category data. The company, not VERTX or Remi, decides whether to interview or hire you.
6.2Because the decision about who is put forward is made automatically, you can ask us for the main reasons for a result, tell us your view, ask for a person on our team to review it, and contest it. Write to privacy@vertxtalent.io or use Support in your dashboard. Our Privacy Policy, section 6, explains this in full.
6.3We do not ask about your health or any disability before introducing you, except to ask whether you need any adjustments for an interview or for using the Platform. If you do, tell us, and we will share what you need with a company only if you agree.
7Your data
7.1Once your right to work check is passed, your profile is shared only with verified UK companies whose roles or searches you match. It is never published on our website unless you choose that separately.
7.2We never show your profile to your current employer unless you tell us we may, and you can withdraw that at any time.
7.3The salary you are looking for is shown to companies. Your private minimum salary is never shown to any company; it only stops us showing you jobs that pay less.
7.4We handle your data as described in our Privacy Policy and Applicant Privacy Notice.
7.5You can delete your profile at any time from Settings, or by asking us. We then remove it from every company's view straight away and delete your data, except two records the law requires us to keep: the record of the introductions we made (which companies, which roles, when and what was shared), kept for one year from the last time we provided a service to you, and the record of your right to work check (clause 3.7). We may have to show these records to the Fair Work Agency, which oversees employment agencies.
8Fair use
8.1You must be 18 or over to create a profile, and by creating one you confirm that you are.
8.2Use the Platform honestly: your own name, your own work and your own answers. We may close a profile that is not genuine, or that belongs to someone other than the person using it.
8.3If you see content on the Platform that is unlawful, infringes your rights or should not be there, report it through our Report content page (vertxtalent.io/legal/report-content), with the Report control where one is shown, or to legal@vertxtalent.io. The same page explains how to appeal if we restrict or remove your content or your profile.
9Complaints
9.1If you are unhappy with anything we have done, tell us first at hello@vertxtalent.io or through Support in your dashboard. We acknowledge every complaint within 30 days, look into it, and tell you the outcome without undue delay.
9.2You can also complain to the Fair Work Agency about how an employment agency has treated you, and to the Information Commissioner's Office (ico.org.uk) about how we use your personal data.
10Changes
10.1We may update these terms.
10.2If a change materially affects you, we will tell you and ask you to accept the new version before you continue.
